1. Interpretation

In these Terms and Conditions:
"Company” means Livefoods Unlimited.
"Customer” means purchaser of Goods from the Company.
"Goods” means all goods sold and/or delivered by the Company.
"Terms” means these terms and conditions of website use and sale.

2. Terms of Use

By using or accessing this website the Customer acknowledges that they have read, understood and agree to be bound by these Terms.

3. Disclaimer of Liability

The Company shall not be responsible for and disclaims all liability for any loss, liability or damage, personal injury or expense of any nature whatsoever which may be suffered by you or any third party which may be attributable, directly or indirectly, to your access and use of this website, any information contained in the website, your personal information or material and information transmitted over the Company’s system.

4. Revisions

The Company may revise these Terms at any time and by posting these revisions on this website they become effective immediately.

5. Terms of Purchase

By completing the registration form and/or purchasing Goods from this website an agreement exists between you and the Company. By completing this registration form you warrant that all information provided by you is accurate and truthful. The Customer will promptly notify the Company if there is any change to this information. You are responsible for the safekeeping of your username and password and you are liable if an unauthorised party uses your username and password.

6. Prices

Prices are determined at the time of order and the Company reserves the right to change any prices without notice at any time up until the Goods have been paid for in full.

7. Orders

The Company may reject an order for any reason including but not limited to the unavailability of the Goods, an error in pricing, description or image of a product or an error or omission in the order. Orders may not be cancelled once the order has been submitted to Livefoods Unlimited through the website.

8. Payment

Goods must be paid for in full using either PayPal, the website’s secure credit card facility, direct deposit into the Company’s bank account or by forwarding a cheque or money order to the Company. While the Company endeavours to ensure all payment options are safe and secure, the Company is not liable for any problems that may arise through the use of the third party payment options available on this website.

9. Shipping

While Livefoods Unlimited will try to keep all shipping costs up to date at all times it may alter freight costs charged to the Customer at any time without notice due to changes in shipping costs imposed by the relevant transport company.

10. Delivery

No Goods will be dispatched until payment has been received in full. The Company will not be held liable for any Goods either not delivered or delivered at a later date than expected due to inaccurate information being provided by the Customer at the time of ordering. The Company is not liable for any loss or damage caused by a third party responsible for the shipping of its Goods.

11. Guarantees

The Company guarantees that the Goods supplied will be received by the Customer in good order and undertakes to replace Goods that are damaged, dead, moribund or otherwise faulty on delivery under the following conditions:


  • The Customer must notify the Company of any problems immediately on receipt of the Goods.
  • Photographic evidence will be required as proof of losses of live insects.
  • Replacement live insects will only be supplied if the losses exceed 20% of the total order, are shown not to have been caused by negligence on the part of the Customer in retrieving delivered orders and are not caused by local extremes of weather i.e. temperatures <6ºC or >33ºC or excessive rainfall.
  • The Company reserves the right to ship replacement insects as part of a new or subsequent order at a later date.

12. Dispatch

Orders must be placed and paid for in full by 5pm Sunday eastern standard time if the customer requires shipping the following week. All direct deposit payments will need to be made by 5pm eastern time the previous Friday to be received into the Livefoods account by the following Monday morning. Any orders or payments received after this time will be shipped the following week.
